Introduction

This purchase is governed by the standard terms of sale below for consumer purchases of goods over the Internet. Consumer purchases over the internet are mainly regulated by the Norwegian Contracts Act, the Consumer Purchases Act, the Marketing Control Act, the Right of Withdrawal Act and the E-Commerce Act, and these laws give the consumer mandatory rights. The laws are available at www.lovdata.no . The terms of this agreement shall not be understood as any limitation of the statutory rights, but set out the most important rights and obligations of the parties for the purchase.

The agreement

The agreement between buyer and seller consists of these terms of sale, information given in the ordering solution of the online store, any direct communication between the parties by email or post, at invoicing, and any specially agreed terms regarding the nature, quality, price, delivery terms and any other properties of the goods.
In the event of any conflict between the information, what has been specifically agreed in the parties' direct communication takes precedence over the sales information, provided it does not conflict with mandatory legislation.

The agreement assumes that the buyer uses the product as the product is intended. We will not allow a game server intended for a specific game to be used for other applications.

Misuse of the agreement

We reserve the right to shut down and close access to game servers if the agreement is misused.

We consider the agreement misused if the game server is used beyond its intended use. This means that the game server is used for something other than running the specific game the buyer ordered at the point of purchase.

If the buyer uses game servers to commit criminal acts, the seller will report the matter and hand over all information to the authorities.

The parties

The seller is NorwayCraft Group AS, kundeservice@norwaycraftgroup.com, 928 793 176MVA, hereinafter referred to as seller/the seller.

The buyer is the consumer who places the order, hereinafter referred to as buyer/the buyer.

Prices

The stated price for the goods and services is the total price the buyer must pay. This price includes all fees and additional costs. The buyer shall not bear additional costs that the seller has not informed about before the purchase.

The order

The buyer is responsible for filling in all information, and that this information is correct, where this is required when ordering. If the buyer does not meet the requirements when ordering, this will not give the buyer a right to complain, and the delivery will be considered completed, even if the installation process cannot be completed until correct information has been filled in.

Entering into the agreement

The agreement is binding for both parties once the buyer has sent their order to the seller.
The agreement is nevertheless not binding if there has been a typing or keying error in the offer from the seller in the ordering solution of the online store or in the buyer's order, and the other party realized or should have realized that such an error existed.

Payment

The seller may demand payment for the goods from the time they are sent from the seller to the buyer.

If the buyer uses a credit card or debit card for payment, the seller may reserve the purchase amount on the card when ordering. The card is charged on the same day the goods are sent.

When paying by invoice, the invoice is issued to the buyer when the goods are sent. The payment deadline is stated on the invoice and is at least 14 days from receipt. If the invoice is not paid by the deadline, all servers will be temporarily suspended pending payment.

Delivery

Delivery has taken place when the buyer, or their representative, has been given access to the server configuration.

If the delivery time is not stated in the ordering solution, the seller shall deliver the goods to the buyer virtually without undue delay and no later than 30 days after the order from the customer. The goods shall be delivered to the buyer unless otherwise specifically agreed between the parties.

Risk for the goods

The risk for the goods passes to the buyer when they, or the buyer's representative, have had the goods delivered in accordance with the agreement.

Right of withdrawal

The buyer may cancel the purchase of the goods in accordance with the provisions of the Right of Withdrawal Act. The right of withdrawal means that the buyer may return the goods to the seller without reason, even if there is no defect and even if they have not been delivered. If the customer has not started using the service, i.e. not used the game server, the customer must notify the seller of the use of the right of withdrawal within 14 days after the goods and the prescribed information about the right of withdrawal and the withdrawal form have been received. We also offer all new customers a 7 day open purchase. The customer may at any time (within the first 7 days after the product's first invoice has been paid) withdraw from the agreement and demand a full refund. The 7 day open purchase can only be used once per customer. If the buyer receives the withdrawal form and the necessary information later than at delivery of the goods, the withdrawal period starts from the day the buyer receives the withdrawal form and the information. If the buyer has not received sufficient information or a withdrawal form, the withdrawal period will nevertheless expire 3 months after the goods were received. If the buyer has not received information about the right of withdrawal at all, the deadline will be 1 year. For evidential reasons, the notice from the buyer to the seller about the use of the right of withdrawal should be in writing (withdrawal form, email or letter), and it must contain information about how the buyer will return the goods to the seller. 4 Cf. model agreement prepared by the joint contract committee of the Savings Banks Association and the Finance Industry's main organization - Terms for credit cards and charge cards -consumer relations section 12 and model terms prepared by the Savings Banks Association and the Finance Industry's main organization for payment cards section 11. 5 Act of 21 June 1985 no. 82 on credit purchases etc. 6 Persons under 18 can only pay in the ways mentioned, as they cannot incur debt, cf. Act of 22 April 1927 on guardianship of minors (vgml.) § 2. 7 Act of 21 December 2000 no. 105 on the duty to provide information and the right of withdrawal etc. in distance selling and off-premises sales (Right of Withdrawal Act). 4 When using the right of withdrawal, the goods must be returned to the seller within a reasonable time. The seller is obliged to refund the entire purchase amount to the buyer within 14 days from the day the seller receives the goods or the collection slip, or the goods are placed at the seller's disposal. The seller cannot charge fees for the buyer's use of the right of withdrawal, but the seller may require the buyer to pay the costs of the return shipment. The buyer may examine the product before cancelling the purchase. The goods must nevertheless be able to be returned to the seller in approximately the same condition and quantity as when the buyer received them. The buyer should send the goods back to the seller in the original packaging if possible. The buyer cannot cancel the purchase of goods that deteriorate quickly, goods that by their nature cannot be returned, or audio and video recordings (including CDs, DVDs) or computer software where the seal has been broken. The latter exception only applies if the seller has clearly informed about the conditions for losing the right of withdrawal on the seal.

Delay and non-delivery - the buyer's rights and deadline for making claims

If the seller does not deliver the goods or delivers them too late in accordance with the agreement between the parties, and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the rules in chapter 5 of the Consumer Purchases Act, depending on the circumstances withhold the purchase price, demand fulfilment, cancel the agreement and/or claim compensation from the seller.

When making claims for remedies for breach, the notice should for evidential reasons be in writing (for example email).

Fulfilment

The buyer may uphold the purchase and demand fulfilment from the seller. However, the buyer cannot demand fulfilment if there is an obstacle the seller cannot overcome, or if fulfilment would cause such great inconvenience or cost for the seller that it is substantially disproportionate to the buyer's interest in the seller fulfilling. Should the difficulties cease within a reasonable time, the buyer may still demand fulfilment.

The buyer loses the right to demand fulfilment if they wait an unreasonably long time to make the claim.

Cancellation

If the seller does not deliver the goods at the time of delivery, the buyer shall ask the seller to deliver within a reasonable additional deadline for fulfilment. If the seller does not deliver the goods within the additional deadline, the buyer may cancel the purchase.

However, the buyer may cancel the purchase immediately if the seller refuses to deliver the goods. The same applies if delivery at the agreed time was decisive for entering into the agreement, or if the buyer has notified the seller that the time of delivery is decisive.

If the item is delivered after the additional deadline set by the consumer or after the time of delivery that was decisive for entering into the agreement, a claim for cancellation must be made within a reasonable time after the buyer learned of the delivery.

The seller may cancel the agreement if there is a material payment default or other material breach on the part of the buyer. The seller cannot, however, cancel if the entire purchase price has been paid. If the seller sets a reasonable additional deadline for fulfilment and the buyer does not pay within this deadline, the seller may cancel the purchase.

Compensation

The buyer may claim compensation for losses suffered as a result of the delay. This does not apply, however, if the seller proves that the delay is due to an obstacle beyond the seller's control which could not reasonably have been taken into account at the time of the agreement, avoided, or whose consequences could not have been overcome.

Defects in the goods - the buyer's rights and deadline for complaints

If there is a defect in the goods, the buyer must, within a reasonable time after it was discovered or should have been discovered, notify the seller that they intend to invoke the defect. The buyer has always complained in time if this happens within 2 months from when the defect was discovered or should have been discovered. Complaints can be made no later than two years after the buyer took over the goods. If the goods or parts of them are intended to last substantially longer than two years, the complaint deadline is five years.

As servers are intended to last for the duration of the agreement, complaints must be made within a reasonable time. Updates and similar may change the experience, and in that case the complaint should be made within 14 days. The remaining part of the agreement will then be cancelled.

If the goods have a defect and this is not due to the buyer or circumstances on the buyer's side, the buyer may, in accordance with the rules in chapter 6 of the Consumer Purchases Act, depending on the circumstances withhold the purchase price, choose between repair and redelivery, demand a price reduction, demand that the agreement be cancelled and/or claim compensation from the seller.

Complaints to the seller should be made in writing.

Repair or redelivery

The buyer may choose between demanding that the defect be repaired or delivery of an equivalent item. The seller may nevertheless oppose the buyer's demand if carrying it out is impossible or causes the seller unreasonable costs. Repair or redelivery shall be carried out within a reasonable time. As a starting point, the seller is not entitled to make more than two attempts to remedy the same defect.

Price reduction

The buyer may demand an appropriate price reduction if the goods are not repaired or redelivered. This means that the ratio between the reduced and the agreed price corresponds to the ratio between the value of the item in defective and contractual condition. If special reasons warrant it, the price reduction may instead be set equal to the significance of the defect for the buyer.

Buyer's rights

Read what the Consumer Council says about your rights here.

The seller's rights in the event of the buyer's breach

If the buyer does not pay or fulfil the other obligations under the agreement or the law, and this is not due to the seller or circumstances on the seller's side, the seller may, in accordance with the rules in chapter 9 of the Consumer Purchases Act, depending on the circumstances withhold the goods, demand fulfilment of the agreement, demand that the agreement be cancelled and claim compensation from the buyer. Depending on the circumstances, the seller may also claim interest on late payment, a debt collection fee and a reasonable fee for uncollected goods.

Fulfilment

The seller may uphold the purchase and demand that the buyer pays the purchase price. If the goods have not been delivered, the seller loses this right if they wait an unreasonably long time to make the claim.

Interest on late payment/debt collection fee

If the buyer does not pay the purchase price in accordance with the agreement, the seller may claim interest on the purchase price under the Late Payment Interest Act. In the event of non-payment, the claim may, after prior notice, be sent to debt collection. The buyer may then be held liable for fees under the Debt Collection Act.

Fee for uncollected goods not paid in advance

If the buyer fails to collect unpaid goods, the seller may charge the buyer a fee. The fee shall at most cover the seller's actual costs of delivering the goods to the buyer. Such a fee cannot be charged to buyers under 18.

Warranty

A warranty given by the seller or the manufacturer gives the buyer rights in addition to those the buyer already has under mandatory legislation. A warranty therefore does not limit the buyer's right to complain and make claims for delay or defects under sections 9 and 10.

Personal data

The seller is the data controller for collected personal data. Unless the buyer consents to something else, the seller may, in accordance with the Personal Data Act, only collect and store the personal data necessary for the seller to fulfil the obligations under the agreement. The buyer's personal data will only be disclosed to others if it is necessary for the seller to carry out the agreement with the buyer, or in cases required by law.

Dispute resolution

Complaints are directed to the seller within a reasonable time, cf. sections 9 and 10. The parties shall try to resolve any disputes amicably. If this is not successful, the buyer may contact the Norwegian Consumer Authority for mediation. The Consumer Authority is available by phone at 23 400 600 or www.forbrukertilsynet.no.

The European Commission's complaints portal can also be used if you wish to file a complaint. This is particularly relevant if you are a consumer living in another EU country. The complaint is filed here: http://ec.europa.eu/odr.

What happens if you do not pay an automatically created invoice in our payment panel

When the buyer chooses not to pay the automatically created invoice for existing servers in the payment panel, which you find at client.proservere.com, the following will happen:

Right after the due date, the server will be suspended. Effectively the server will be frozen, but it will then still be possible to reactivate the service with the server.

7 days after the due date, the server will be deleted, and it will then be impossible to restore the server and the service.

If the buyer orders a new service, the service will create an automatic invoice in our payment panel. It will be possible to pay this and activate the service for 7 days. If the buyer chooses not to pay for the order, the order will automatically be cancelled and cannot be restored.

Special terms for Minecraft

By using our service, you are obliged to accept Mojang's EULA rules. Proservere, a trademark of NorwayCraft Group AS, provides the service independently of Mojang, and is in no way associated with Mojang.

Plugins, mods, maps and other modifications are the buyer's responsibility to configure and maintain, and errors in such modifications are not the seller's responsibility, as this is solely the buyer's responsibility.

For "modpacks" orders, it is the buyer's responsibility to make sure the versions they choose are compatible with the Java version they choose.

Handling of backups

As a customer, you are responsible for setting up or creating backups, and securing them by downloading and storing them. We do not take responsibility for managing these.

You can do this in the game panel by going to the "Backups" tab; create backup. You can download each backup by clicking the three dots and then choosing download.
